High Court Clears Daddy Lumba’s Funeral to Proceed-Wife’s Injunction Dismissed

The High Court in Kumasi has paved the way for the final funeral rites of Ghanaian music legend Charles Kwadwo Fosu, popularly known as Daddy Lumba, to proceed as scheduled in December 2025.
The ruling follows the court’s dismissal of an interlocutory injunction application filed by the late musician’s wife, Akosua Serwaa, who sought to restrain the family from organizing the funeral until certain internal matters were addressed.
Speaking to the media after proceedings, counsel for Akosua Serwaa, Lawyer William Kusi, said the legal team was generally satisfied with the judgment, noting that one part of the decision favored them, though their request to temporarily halt the funeral was rejected.
Delivering her ruling, Justice Dorinda Smith Arthur upheld that under Ghanaian customary law, ultimate authority over a deceased person’s remains rests with the family, not the spouse. She stressed that delaying the funeral would not serve the interest of the family or the public.
Accordingly, the application for interlocutory injunction is hereby refused, the judge stated.
The family has since reaffirmed that Daddy Lumba will be laid to rest on December 6, 2025, clearing all legal hurdles ahead of the final farewell to the highlife icon.
